Frequently Asked Questions

Family law explained clearly

How does a divorce proceed?

As a rule, a divorce requires a one-year period of separation. After that, one spouse files the divorce application with the family court through a lawyer. The divorce is pronounced at the court hearing – often together with the pension equalisation. We will support you throughout the entire proceedings.

Who pays how much maintenance?

The amount of child and spousal maintenance depends on income, need and capacity to pay. The Düsseldorfer Tabelle serves as a guide for child maintenance. We calculate your entitlement and enforce it – or defend against excessive claims.

What does equalisation of accrued gains mean?

In a divorce under the statutory matrimonial property regime, the increase in assets accumulated during the marriage is equalised between the spouses. We determine the claims and represent you in the settlement.

Do we both need a lawyer?

Legal representation is required for filing the divorce application. In the case of an amicable divorce, it is often sufficient for only one spouse to be legally represented. We will discuss with you what makes sense in your case.

What does a family law solicitor cost?

The costs depend on the value of the proceedings, which in the case of a divorce is primarily determined by the spouses' income, and on the Rechtsanwaltsvergütungsgesetz (RVG). Before the mandate begins, we discuss the anticipated costs with you transparently. If income is low, legal aid for the proceedings (Verfahrenskostenhilfe) may be available – we will submit the application on your behalf.

Which family court has jurisdiction in Limburg?

For divorces, maintenance and child matters, the Family Court at the Amtsgericht has jurisdiction – for Limburg and the surrounding area, this is generally the Amtsgericht Limburg an der Lahn. We represent you there and, if necessary, in the second instance before the Oberlandesgericht Frankfurt am Main.

Let us discuss your situation in confidence.

The first step is often the hardest. We listen and show you your options.
